One of the more worrying aspects of Racepoint’s objectives

and NGOs,” including, presumably, the critiques
of the crackdown on dissent among political opponents
overseas.
This should be seen in the context of accusations
that Rwanda has plotted to kill dissidents abroad. A
recent investigation by the Globe and Mail claims, “Rwandan
exiles in both South Africa and Belgium – speaking in clandestine meetings in secure locations because of their fears of attack – gave detailed accounts of being recruited to assassinate critics of President Kagame….

How to proceed for revolution in Rwanda:
- The people should overthrow the Rwandan dictator (often put in place by foreign agencies) and throw him, along with his henchmen and family, out of the country – e.g., the Shah of Iran, Marcos of Philippines.Compaore of Burkina Faso
- Rwandans organize a violent revolution and have the dictator killed – e.g., Ceaucescu in Romania.
- Foreign powers (till then maintaining the dictator) force the dictator to exile without armed intervention – e.g. Mátyás Rákosi of Hungary was exiled by the Soviets to Kirgizia in 1970 to “seek medical attention”.
- Foreign powers march in and remove the dictator (whom they either instated or helped earlier) – e.g. Saddam Hussein of Iraq or Manuel Noriega of Panama.
- The dictator kills himself in an act of desperation – e.g., Hitler in 1945.

WICHITA, Kan. — A jury that convicted a Kansas man of lying to immigration officers about his whereabouts during the 1994 Rwandan genocide also unanimously agreed that he had no role in the mass killings, two jurors told The Associated Press on Friday.
"We didn't think the prosecution did a very good job," juror Richard Shain said. "They put all their eggs in the genocide basket, and it didn't prove out."
The comments by the jurors provide a first glimpse into the deliberations in a case prosecutors have said was the first in the nation requiring proof of genocide.
Lazare Kobagaya, 84, of Topeka was convicted Tuesday of one count of lying to immigration officials about his whereabouts when he filled out his visa application.
The jury deadlocked 10-2 to convict on a separate count regarding whether Kobagaya lied during citizenship proceedings. Bill Nelson, the other juror interviewed by AP, said that was because two people were adamant prosecutors failed to prove criminal intent when the elderly immigrant filled out some citizenship paperwork.
"All they proved (was) that he was there in 1994, and that was all they could prove," Nelson said. "They couldn't prove he was in on any killing, looting or burning."
The jury found that Kobagaya lied on his visa application to move to the U.S. when he wrote that from 1993 until 1995, he was in his native Burundi. But jurors rejected the allegation that he lied when he said he didn't engage in genocide.
"We know he didn't physically participate, but the accusation was essentially that he was trying to incite people and stuff like that – and we really didn't think that had ever been proven," Shain said.
Kobagaya's attorney said the juror comments helped underscore the defense's position.
"We are pleased to learn that the jury believed what we knew all along: Lazare Kobagaya is innocent," defense attorney Kurt Kerns said in an email.
The Justice Department said in a statement it appreciated the service of the jurors, who determined Kobagaya was guilty of visa fraud.
"As in any case, the government presents the facts and evidence it believes supports its allegation and ultimately a jury determines a defendants' guilt or innocence," the department said in an email. "Generally speaking, we take seriously our obligations to enforce our criminal laws and to ensure that human rights violators are not granted safe haven in this country."
Shain said jurors generally felt there was a lot of money wasted in prosecuting Kobagaya.
The defense team did a good job of instilling reasonable doubt and knocking aside those allegations, Shain said. The fact the government's witnesses were admitted killers was expected and was not a factor in the jury's decision, he said.
"It is hard to explain, it just didn't come off as being believable," Shain said of the government's genocide allegations.
Had prosecutors put as much effort on proving falsification of immigration documents, the jury could have been swayed in that direction, Shain said. He was among the majority who wanted to convict on both counts for lying on immigration documents.
U.S. District Judge Monti Belot declared a mistrial on the one count over which jurors deadlocked, and prosecutors have not said whether they will seek a retrial.
Nelson, who voted with the majority for a conviction on that count, said he sat through the whole trial wondering how much the government was spending on the prosecution.
"After everything was over, I asked the judge and he told me the government had spent at least a million dollars, and then he informed me that Kobagaya had appointed attorneys."
Government and defense attorneys have traveled to Rwanda with their investigators, translators and a court reporter to take depositions. Taxpayers also are picking up the tab for all defense costs for Kobagaya, who has two court-appointed attorneys. At least 45 foreign witnesses were brought to the United States, although not all testified. Each foreign witness was paid $96 a day over more than six weeks they remained in the United States.
The count on which jurors deadlocked had to do with his citizenship application. On that count, prosecutors alleged Kobagaya made four false statements when asked whether he ever persecuted anyone, committed a crime for which he was not arrested, gave false information to immigration officials or lied to gain entry to the United States. Jurors deadlocked on whether any of those statements were false.
One holdout juror believed Kobagaya didn't understand English well enough when he filled out the paperwork, Nelson said. The other juror felt Kobagaya was innocent and felt the government didn't dwell on the paperwork allegations enough.
"The biggest thing with people was the intent," Shain said.
Most jurors had wanted to return a guilty verdict on that count because the evidence showed "a pattern of what he was willing to do" in order to bring family members into the United States.
On some documents, he falsely represented to authorities that his grandchildren were his son and daughter. Other evidence showed Kobagaya also tried to get one of his married sons into the United States by urging him to tell authorities that he had never been married and that the mother of his child had died, when in fact the son was married and his wife was still alive.

The unemployment rate for the Hutu young people rises to its highest recorded level (a rise of 15% per cent), and is expected to continue increasing. Main reason: Discrimination, genocide idelology and hatred between the main ethnic groups in Rwanda feuled the hatred speech by the RPF leadership and government.
ASI strongly believe that there is no political problem, ethnic hatred issues included, for which peaceful solution does not exist.
The logic behind the tensions from the Hutu side is mainly the fact that the majority Hutu is totally marniginalized both politically and economically. Contrary to expectations, Tony Blair is fueling hatred between both ethnic group as the main Kagame advisor, an extremist Tutsi, who took power in in 1994 by a bloody coup.

Freedom of expression in Rwanda has been unduly restricted for many years. The months leading up to the August 2010 presidential elections were marked by a clampdown on freedom of expression, which still shows no sign of abating. In this campaign digest Amnesty International calls on the Rwandan authorities to allow opposition politicians, journalists and human rights defenders and others to express their views without fear for their safety and to accelerate the review of the "genocide ideology" law and the 2009 media law.
The Rwandan Patriotic Front (RPF), in power since the 1994 genocide, tightly controls political space, civil society and the media, contending that this is necessary to prevent renewed violence. Human rights defenders, journalists and political opponents cannot openly and publicly criticize the authorities. People who do speak out risk prosecution and imprisonment.

Restrictions on freedom of association and expression prevented new opposition parties from contesting the August 2010 elections. During this period, journalists were subjected to criminal sanctions for defamation. The Rwandan government did not respond constructively to criticism but rather tried to stamp it out.
CRIMINALIZING CRITICISM
Vague and sweeping laws on “divisionism” and “genocide ideology” were introduced in Rwanda in the decade after the 1994 genocide. Up to 800,000 Rwandans were killed in the genocide, mostly ethnic Tutsi, but also Hutu who opposed the organized killing. The laws prohibit hate speech, but are broadly drafted so

The Rwandan government has expressed a commitment to review laws which criminalize criticism, but recent trials of journalists and opposition politicians suggest that Rwanda’s clampdown on critics shows no sign of abating.

"Kobagaya was accused of lying when he applied for a visa to enter the United States when he stated that he lived in Burundi rather than Rwanda from 1993 to 1995. During trial, the government argued that the lie was material because it prevented the government from examining Kobagaya's activities during the 1994 Rwandan genocide. Based on court documents and information presented at trial, the jury found that Kobagaya lied during his immigration process about where he resided during that time period.
The case was investigated by special agents from the U.S. Immigration and Customs Enforcement's ( ICE ) Homeland Security Investigations ( HSI ) Resident Agent in Charge office in Wichita, Kan. ICE HSI special agents interviewed more than 50 witnesses from Africa during a three year period to present evidence in this case that Kobagaya lied about residing in Rwanda during the 1994 genocide to gain entry into the United States.
The case was prosecuted by Senior Trial Attorneys Christina P. Giffin, Steven C. Parker and Deputy Chief Robert G. Thomson of the Department of Justice's Criminal Division's Human Rights and Special Prosecutions Section ( HRSP ), with support from Assistant U.S. Attorney Alan Metzger for the District of Kansas.
ICE places a high priority on targeting alleged human rights abusers through its Human Rights Violators and War Crimes Center. ICE HSI has more than 200 active investigations, and is pursuing over 1,400 leads and removal cases involving suspects from approximately 95 different countries. These cases are predominantly focused on Central and South America, Haiti, the former Yugoslavia and Africa. They represent cases in various stages of investigation, prosecution or removal proceedings."

The rule of law is constantly rejected and authoritarian answers are offered as panaceas for all our problems. Runaway welfarism is used to benefit the rich at the expense of the middle class.
Who would have ever thought that the current generation and Congress would stand idly by and watch such a rapid disintegration of the American Republic?
Characteristic of this epic event is the casual acceptance by the people and political leaders of the unitary presidency, which is equivalent to granting dictatorial powers to the President. Our Presidents can now, on their own: And all of this is not enough. The abuses and usurpations of the war power are soon to be codified in the National Defense Authorization Act now rapidly moving its way through the Congress. Instead of repealing the 2001 Authorization for the Use of Military Force (AUMF), as we should, now that bin Laden is dead and gone, Congress is planning to massively increase the war power of the President.
1.Order assassinations, including American citizens,
2.Operate secret military tribunals,
3.Engage in torture,4.Enforce indefinite imprisonment without due process,
5.Order searches and seizures without proper warrants, gutting the 4th Amendment,
6.Ignore the 60 day rule for reporting to the Congress the nature of any military operations as required by the War Power Resolution,
7.Continue the Patriot Act abuses without oversight,
8.Wage war at will,
9.Treat all Americans as suspected terrorists at airports with TSA groping and nude x-raying.
Though an opportunity presents itself to end the wars in Iraq, Afghanistan, and Pakistan, Congress, with bipartisan support, obsesses on how to expand the unconstitutional war power the President already holds. The current proposal would allow a President to pursue war any time, any place, for any reason, without Congressional approval. Many believe this would even permit military activity against American suspects here at home.
The proposed authority does not reference the 9/11 attacks. It would be expanded to include the Taliban and “associated” forces—a dangerously vague and expansive definition of our potential enemies. There is no denial that the changes in S.1034 totally eliminate the hard-fought-for restraint on Presidential authority to go to war without Congressional approval achieved at the Constitutional Convention.
The proposed authority does not reference the 9/11 attacks. It would be expanded to include the Taliban and “associated” forces—a dangerously vague and expansive definition of our potential enemies. There is no denial that the changes in S.1034 totally eliminate the hard-fought-for restraint on Presidential authority to go to war without Congressional approval achieved at the Constitutional Convention.
Congress’ war authority has been severely undermined since World War II beginning with the advent of the Korean War which was fought solely under a UN Resolution. Even today, we’re waging war in Libya without even consulting with the Congress, similar to how we went to war in Bosnia in the 1990s under President Clinton.

Wikileaks Confirm US Interference In Spanish Genocide Case Against Kagame
A blog claims to have spoken to Justus Majyambere at his home in Kigali who said:
"he went to the US and returned safely and had not been stopped by anyone while in Amsterdam, Detroit or Kansas."
That means both the US and The Netherlands could have possibly failed to honor a red notice, provisional arrest request, or extradition request.
This story is getting really interesting considing that Wikileaks of US Embassy cables make it clear failure to honor a red notice in this case would be considered a serious problem.
Justus Majyambere is not only one of the 40 Rwandan officers sought by Spanish justice, in addition he is also one of the 15 that are wanted for the murder of nine Spanish citizens. This means that if the US failed to honor a red notice in this case, it could have serious repercussions:
"Fifteen of the forty indictees (#'s 3, 5, 6, 8, 11, 12, 13, 14, 15, 16, 17, 19, 23, 24, 29) are wanted for the murder of the nine Spanish citizens." "It would be a serious problem if the USG failed to honor a red notice, provisional arrest request, or extradition request for one of the 15 indictees sought for murdering the Spaniards, especially with respect to other ongoing bilateral extradition and judicial matters."

The United States government should step up efforts to protect civilians in central Africa from abuses by Paul Kagame and his proxy armies. African SurViVors International (ASI) will be watching closely to ensure that the specialized Court for Kagame crimes in the D.R. Congo is established as a truly independent, effective, and credible International Court.
The Obama administration should make good on its pledge to work with recipients of US military assistance to end Kagame presence in the D.R. of The Congo.La situation générale des droits de l’homme en République démocratique du Congo demeure très préoccupante, comme le soulignent les derniers rapport en date de la Haut-Commissaire aux droits de l’homme (A/HRC/16/27), du Secrétaire général (S/2010/512) et du Groupe d’experts sur la République démocratique du Congo du Comité des sanctions du Conseil de sécurité (S/2010/596), et les 13 communications envoyées par quatre des sept titulaires de mandat au titre des procédures spéciales thématiques depuis mars 2010.
Dans sos rapport,la Haut-Commissaire aux droits de l’homme a noté que la situation des droits de l’homme dans le pays ne s’est pas améliorée depuis son rapport précédent. Cette situation demeure extrêmement préoccupante, en particulier dans la partie est du pays, où le Bureau conjoint des Nations Unies pour les droits de l’homme en République démocratique du Congo continue d’enregistrer des violations graves des droits de l’homme et des violations graves du droit international humanitaire commises par les forces armées nationales et les groupes armés.
La plupart de ces violations sont liées au conflit et commises dans le cadre d’opérations militaires menées par les Forces armées dela République démocratique du Congo (FARDC) contre les groupes armés et/ou en représailles à ces opérations par les groupes armés, y compris les combattants de l’Armée de résistance du Seigneur, les Forces démocratiques de libération du Rwanda (FDLR) et les groupes Maï Maï.

Paul Kagame, the country’s de facto leader since marching into Rwanda at the head of a Tutsi rebel army in the summer of 1994, calls himself a Rwandan. The words “Tutsi” and “Hutu” have been erased from identity cards and excised from open conversation. I am Jean-Christophe Nizeyimana, an Economist, Content Manager, and EDI Expert, driven by a passion for human rights activism. After suffering THE LONG years, telling the world that Kagame and his RPF criminal organization masterminded the Rwandan genocide that they later recalled Genocide against Tutsis. Our lives were nothing but suffering these last 32 years beginning from October 1st, 1990 onwards. We are calling the United States of America, United Kingdom, Japan, and Great Britain in particular, France, Belgium, Netherlands and Germany to return to hidden classified archives and support Honorable Tito Rutaremara's recent statement about What really happened in Rwanda before, during and after 1994 across the country and how methodically the Rwandan Genocide has been masterminded by Paul Kagame, the Rwandan Hitler. Above all, Mr. Tito Rutaremara, one of the RPF leaders has given details about RPF infiltration methods in Habyarimana's all instances, how assassinations, disappearances, mass-slaughters across Rwanda have been carried out from the local autority to the government,fabricated lies that have been used by Gacaca courts as weapon, the ICTR in which RPF had infiltrators like Joseph Ngarambe, an International court biased judgments & condemnations targeting Hutu ethnic members in contraversal strategy compared to the ICTR establishment to pursue in justice those accountable for crimes between 1993 to 2003 and Mapping Report ignored and classified to protect the Rwandan Nazis under the RPF embrella . NOTHING LASTS FOREVER.
