  2. Rwandans organize a violent revolution and have the dictator killed – e.g., Ceaucescu in Romania.
  3. Foreign powers (till then maintaining the dictator) force the dictator to exile without armed intervention – e.g. Mátyás Rákosi of Hungary was exiled by the Soviets to Kirgizia in 1970 to “seek medical attention”.
  4. Foreign powers march in and remove the dictator (whom they either instated or helped earlier) – e.g. Saddam Hussein of Iraq or Manuel Noriega of Panama.
  5. The dictator kills himself in an act of desperation – e.g., Hitler in 1945.
  6. The dictator is assassinated by people near him – e.g., Julius Caesar of Rome in 44 AD was stabbed by 60-70 people (only one wound was fatal though).

The current government has been characterized by the total impunity of RPF criminals, the Tutsi economic monopoly, the Tutsi militaristic domination, and the brutal suppression of the rights of the majority of the Rwandan people (85% are Hutus)and mass arrests of Hutus by the RPF criminal organization =>AS International]

On 26 May 2013 in Addis Ababa the UN Secretary General, Mr. Ban Ki-moon and the Chairperson of the African Union Commission Dr. Nkosazana Dlamini Zuma, convened the first meeting of the Regional Oversight Mechanism of the Peace, Security and Cooperation Framework for the DRC and Region. It was at this important meeting where the President of the United Republic of Tanzania, H.E. Jakaya Mrisho Kikwete made what many level headed commentators have referred to as candid and commonsensical remarks about the protracted conflicts in the Great Lakes Region.

 - a seasoned and consummate diplomat who has helped broker many peace deals in Africa - remarked that it was high time Rwanda and Uganda gave serious attention to peace talks with FDLR and ADFrebels respectively. He said, and correctly so, that it was evident the barrel of the gun cannot bring about the ultimate answer as testified by the recurrence of fighting in our region. He never condoned the role that the FDLR rebels played in the 1994 genocide. He was being reasonable and pragmatic.


Rwanda should know better than any other country that there is no way Tanzania would condone or sympathize with the perpetrators of genocide. To make suchinsinuations is, quite frankly, demonstration of breathtaking ignorance about Tanzania’s enviable and unparalleled history - the history of speaking out against any forms of crimes and injustices. Moreover, for Rwanda to make such insinuations is to show just what a short memory span this country has.
Admittedly, genocide brought about painful and unforgettable misery to the people of Rwanda but its spillover effects were felt well beyond its borders. The effects of genocide were felt right inside Tanzania which had to shoulder the burden ofproviding for thousands of Rwandan refugees. By the way, Tanzania has a long history of taking good care of Rwandan refugees both before and after genocide.The sons and daughters of the Rwandan refugees benefitted from Tanzania’sgenerous education system by studying, for free, at the country’s Universities and many of them are now occupying high positions in the Government of their motherland.

So given the foregoing, I have to say that I have been taken aback by ourneighbors’ over-reaction to what was a completely innocuous statement byPresident KikweteIndeed, what the President said could (and should) have been said by other leaders a long time ago. What he said is a no-brainer!  It is common sensical!  Negotiations have a much better chance of resulting into durable peace than the use of force. Thus, I find the reactions from Rwanda not only disturbing but also objectionable and utterly impudent! What is even more shocking is the discourteous behavior shown by the Rwanda’s Foreign Minister.  She seems to be getting too much big for her boots as to suggest that President Kikwete’s statement was absurd! She even has the audacity to ask that he should retract it. If anything, I think it is our Foreign Ministry which should summon the Ambassador of Rwanda in Dar es Salaam and ask him to clarify his Minister’s inadvisable utterances.

For far too long now the international community has adopted a softly softly approach with respect to Rwanda and this has meant that this tiny country gets away with literally everything, even murder. Rwanda has become like a spoiled child - untouchable and overly sensitive to everything even the slightest suggestion of censure. Rwanda has a tendency of not taking kindly any form of criticism whether from within or without. And its leadership comes across as snobbish and delusional. May be the western countries’ plaudits about its so called success story have finally got into the heads of Rwandan leaders so much that they think they know it all.

For Rwanda to say that they cannot engage in talks with FDLR rebels because of their role in 1994 genocide is to allow themselves to be the captives of the past. History is replete with numerous instances of former sworn enemies burying their hatchets and extending an olive branch to one another for the sake of peaceful coexistence and future prosperity. This happened in South Africa where ANC and other progressive movements sat down with the perpetrators of one of the most brutal and inhumane policies in the history of mankind (apartheid) and agreed to work together in an inclusive and democratic society. Similarly, after many decades of committing some of the most heinous crimes against the people of Angola, UNITA is now part of the democratic government of that country. And in 2011, US and its allies initiated direct talks with some elements of the Taliban in Doha (Qatar), if my memory serves me well.
Rwanda should wake up and smell the coffee! Being delusional has not worked and won’t work.
It is now close to 20 yrs since the 1994 genocide and during all that time Rwanda has not been able to achieve its objectives visa vis FDLR rebelsthrough the use of force.  Any sane person in Kigali should see the wisdom of changing the tactic/strategy which is, for all purposes and intents, what our President said in the Statement. Rwanda should understand that by calling for direct talks, Tanzania does not suggest, by any stretch of imagination, that the architects and executors of genocide should go scot free. Not at all! Talks can, and indeed should, offer the mechanism of dealing with known perpetrators of genocide by isolating them from non-perpetrators such as those born after 1994.This is just one example of approaching talks. I am sure there are many others.

But talking of genocide, am wrong in recalling that even President Kagame himself was once found to be complicit in this crime by a French Magistrate? I recall that Rwanda’s reaction to this finding was, as we have come to expect, fast and furious to the extent of severing its diplomatic relations with France. Again, this goes to show that this “spoiled child” can’t stand any sort of censure or straight talking. I also recall that as recent as last year a UN report revealed that Rwanda’s Kagame had committed or assisted in committing genocide in DRC!
Despite all this compelling evidence, neighbors of Rwanda are still ready to engage that country in talks. Why can’t Rwanda show the same attitude? And lest he forgets, Kagame himself and his RPF henchmen come from a background of rebellion. They were rebels operating from Ugandan forests before taking over power in 1994. However, despite their “rebels” status they were invited and took part in the Arusha peace process of the early 1990s.  
Finally, I have a gut feeling that Rwanda doesn’t want FDLR rebels to go away that’s is why it is vehemently opposing the suggestion of talks which is one sure way of ending this conflict once and for allThis because, the perpetual presence of FDLR rebels in DRC gives Rwanda a convenient excuse to interfere in the DRC’s affairs thereby making the country ungovernable for its own economic and geopolitical interests. I read somewhere that Rwanda’s army – which is one of the biggest for a country of that economy and size - is mainly sustained by the exploitation of DRC’s natural resources. So, Rwanda goes into the DRC on the pretext that it is in hot pursuit of the FDLR rebels but in actual fact what it does is to plunder the resources.
And Rwanda is particularly angry with Tanzania because by being part of MONUSCO in DRC, its misdeeds will be exposed and curtailed by our non-nonsense troops. So the over-reaction to our President’s innocuous statement should not be seen in isolation. It is part of the frustration born out of the uneasy situation which Rwanda finds itself in as a result of our troops being part of the UN/SADC intervention force in DRC.

Rwandan president opts out of DR Congo summit




Le président tanzanien, Jakaya Kikwete a salué dimanche 26 mai à Addis-Abeba le projet de la brigade d’intervention de la Monusco pour combattre les groupes armés dans l’Est de la RDC. Au cours d’une réunion à huis clos entre quelques chefs d’Etats africains, il a cependant appelé aux négociations entre Kigali et les rebelles rwandais des FDLR et Kampala avec les rebelles de l’ADF-Nalu, rapporte rfi. Pour le chef de l’État tanzanien, il n’y a pas de paix durable, sans négociation globale.

Devant le secrétaire général de l’Onu, Ban Ki-moon et six de ses pairs africains, le président Jakaya Kiwete, dont le pays fournit des troupes à la brigade d’intervention de la Monusco, a indiqué que cette brigade ne résoudra pas le problème de fonds dans les Grands Lacs, qui est politique.
Selon rfi, le président tanzanien a insisté sur la nécessité d’une reprise du dialogue – actuellement au point mort – entre le gouvernement de Kinshasa et les rebelles du M23. Avec l’annonce en mars dernier de l’arrivée de la brigade d’interventioncensée combattre les groupes armés, Kinshasa avait demandé au M23 de « s’auto dissoudre ». Et les discussions ouvertes à Kampala entre les deux groupes depuis décembre 2012 s’étaient enlisées.
Toujours selon rfi, Jakaya Kikwete a aussi demandé au Rwanda et à l’Ouganda de négocier avec leurs rebelles. Ces derniers se trouvent en RDC où ils commettent de nombreuses exactions sur la population civile.
« Si Kinshasa négocie avec ses ennemis du M23, il faut aussi que Kigali accepte de parler avec ses ennemis des Forces démocratiques de libération du Rwanda (FDLR), et Kampala avec les rebelles ougandais de l’ADF-NALU. Pas de paix durable, sans négociation globale », a dit Jakaya Kikwete, selon la même source.

Le Rwanda a désapprouvé la proposition du chef de l’Etat tanzanien. « Les propos du président Kikwete de Tanzanie sont aberrants », a déclaré la chef de la diplomatie rwandaise, Louise Mushikiwabo, sur RFI.
Pour la ministre rwandaise, les FDLR sont « un groupe de génocidaires qui ont quitté le pays après avoir participé à l’élimination de plus d’un million de Rwandais ».
« Ceux qui pensent que le Rwanda devrait s’asseoir à la table de négociations avec les FDLR ne savent pas de quoi ils parlent », a-t-elle conclu.

With the nostalgic, congratulatory and self-congratulatory speeches and the song and dance over, the grim business of warfare is gripping the attention of the AU summit in Addis Ababa.
The celebration of the 50th anniversary of the founding of the Organisation of African Unity, the AU’s predecessor, was on Saturday. On Sunday, the AU began an ordinary summit which gave much of its attention to conflict on the continent.

This included discussions about Africa’s readiness to bolster West African peacekeeping force Afisma so it is capable of replacing the French force, which is holding the line against jihadists and Tuareg separatists in northern Mali.
The AU’s peacekeeping force in Amisom was widely praised as symbol of the AU’s determination to bring peace and order to Africa. It has driven the al-Qaeda-linked al-Shabaab Islamist extremists from Mogadishu and other cities.
The Intervention Brigade, poised to go into eastern Democratic Republic of Congo (DRC) to neutralise “negative forces – rebel groups, particularly the M23 – terrorising the local population is also a major issue at the summit.
It was discussed in at least three key meetings – among AU leaders, in SADC talks on the sidelines of the main summit and in a meeting of leaders of the UN, AU, SADC and the Great Lakes region.
The last mentioned meeting discussed commitments made in February to restore stability in eastern DRC promises by the DRC government to extend governance and security into the east; undertakings by neighbouring powers – by implication Rwanda, particularly, but also Ugandan president Yoweri Museveni – not to interfere in DRC and commitments by the international community to give support.
Officials said Tanzanian President Jakaya Kikwete, chairman of SADC’s security organ, was blunt at the meeting. He said if DRC President Joseph Kabila could negotiate with the M23 rebels, why could Museveni not negotiate with the ADF-Nalu rebels and Rwandan President Paul Kagame with the FDLR rebels, fighting him from eastern DRC?
Museveni responded that he was ready to negotiate but Kagame was ominously silent. Kagame is widely accused of arming and otherwise backing his ethnic-Tutsi kindred spirits in M23 and everyone is anxious to know how he is reacting to the deployment of the SADC intervention against M23. The journal Jeune Afrique recently quoted him as saying the intervention brigade was a bad idea.
Is he already training M23 and rearming them to try to rout SADC as the rebels have threatened to do? And what impact would that have on Rwanda’s relations with the countries contributing troops to the intervention brigade?
That includes South Africa, which is contributing a battalion, almost certainly to be redeployed from its existing contingent in the UN peacekeeping mission in the DRC, Monusco.
President Jacob Zuma’s pre-occupation with peace and security goes beyond the eastern DRC to a general view that rebel destabilisation is the primary problem bedevilling the advancement of Africa.
At the AU summit yesterday, he repeated his sentiments of the January summit that these rebels must be stopped.
He has shown himself ready to contribute South African troops to a central African regional peacekeeping force preparing to intervene in the Central African Republic to end the anarchy that has gripped the country since Seleka rebels toppled President François Bozizé on March 24 – killing 13 SANDF parabats on the way.
Africa, having celebrated the struggle to liberate itself from colonialism and apartheid, is now clearly on the march to liberate itself from its own malcontents.

The government continued to stifle legitimate freedom of expression and association. Cases of illegal detention and allegations of torture by Rwandan military intelligence were not investigated. Military support from Rwanda to the M23 armed group in the neighbouring Democratic Republic of the Congo (DRC) tarnished Rwanda's international image built on economic development and low levels of corruption. The international community's support for Rwanda wavered.
Background
A final report by the UN Group of Experts on the DRC, published in November 2012, contained evidence that Rwanda had breached the UN arms embargo by transferring arms, ammunition and military equipment to the M23. The report stated that Rwandan military officials were supporting the M23 by recruiting civilians in Rwanda and providing logistics, intelligence and political advice.
In an interim report addendum published in June, the Group of Experts had already named high-ranking Rwandan military officials – including the Minister of Defence – as having played a key role in providing this support. Rwanda published a detailed rebuttal, denying any support and criticizing the methodology and credibility of the sources used.
Major donors to Rwanda, including the USA, the EU, the UK, the Netherlands, Germany and Sweden, subsequently suspended or delayed part of their financial assistance.
In October, Rwanda was elected to hold a non-permanent seat on the UN Security Council for two years starting in 2013.
Community-based gacaca courts, set up to try genocide cases, completed their work in 2012 and were officially closed in June following several delays.
Impunity
The government failed to investigate and prosecute cases of illegal detention and allegations of torture by Rwandan military intelligence. In May and October, Amnesty International published evidence of illegal and incommunicado detention and enforced disappearances. The research included allegations of torture, including serious beatings, electric shocks and sensory deprivation used to force confessions during interrogations, mostly of civilians, in 2010 and 2011.
In May, the government categorically denied all allegations of illegal detentions and torture by Rwandan military intelligence before the UN Committee against Torture. In June, the Rwandan Minister of Justice acknowledged that illegal detentions had occurred, attributing them to operatives' "excessive zeal in the execution of a noble mission". On 7 October, the government issued a statement reaffirming that illegal detentions had taken place, but made no reference to investigations or prosecutions.
  • Sheikh Iddy Abassi, a Congolese religious leader, was abducted in Rwanda on 25 March 2010. He was a known supporter of Laurent Nkunda, a leader of the former Congolese armed group, the National Congress for the Defence of the People (CNDP). His family reported him missing to the local police and military the following day, 26 March. Mary Gahonzire, the Deputy Commissioner General of the Rwanda Correctional Service, told the UN Committee against Torture that investigations were ongoing, but that indications pointed to Sheikh Iddy Abassi being in the DRC.
Freedom of expression
There was almost no space for critical journalism in Rwanda. The aftermath of a 2010 clampdown on journalists and political opposition members left few independent voices in the country. Private media outlets remained closed. Efforts to improve media freedom through legislative reform, technical improvement and private sector investment, were undermined by the continued imprisonment of journalists for their legitimate work. Defamation remained a criminal offence.

Vaguely worded laws on "genocide ideology" and "sectarianism" were misused to criminalize legitimate dissent and criticism of the government. A new draft "genocide ideology" law was before parliament.
Journalists
Several media-related laws were approved by parliament and pending promulgation at the year's end.
  • On 5 April, the Supreme Court reduced the prison sentences of Agnes Uwimana Nkusi, editor of the private Kinyarwanda tabloid newspaper Umurabyo, and her deputy editor, Saidati Mukakibibi, to four and three years respectively. In February 2011, the women were sentenced to 17 and seven years in prison respectively for publishing opinion pieces criticizing government policies and alleging corruption in the run-up to the 2010 presidential elections. The Supreme Court cleared Agnes Uwimana Nkusi of "genocide ideology" and "divisionism" charges but upheld a conviction for defamation. For both women, the sentence for threatening national security was reduced.
Unfair trial
Victoire Ingabire, President of the United Democratic Forces (FDU-Inkingi), was sentenced to eight years in prison on 30 October. She had returned to Rwanda in January 2010 after 16 years in exile. She had hoped to register FDU-Inkingi prior to the August 2010 presidential elections, before she was first arrested in April 2010.

Despite international scrutiny, the trial was marred by violations of due process. The court failed to test evidence brought by the prosecution. Confessions of two co-accused incriminating Victoire Ingabire were made after a prolonged period of detention in a military camp where Amnesty International has documented allegations of the use of torture to coerce confessions. A defence witness claimed he had been held in military detention with one of the co-accused and alleged that the individual's confession had been forced.
In the build-up to the trial, official statements were made by the Rwandan authorities which posed problems in relation to Victoire Ingabire's presumption of innocence. The freedom of expression charges lacked a clear legal basis and certain charges were based on pieces of imprecise and broad Rwandan legislation punishing "genocide ideology" and "discrimination and sectarianism". The accused was not treated fairly during the trial and was regularly interrupted and subject to hostility.
Freedom of association
Certain political parties had still not been able to register. Members of political opposition parties reported being harassed and intimidated, and some were imprisoned for exercising their right to freedom of association.
  • On 27 April, the Supreme Court upheld charges against Bernard Ntaganda, president of the Ideal Social Party (PS-Imberakuri). He is currently serving a four-year prison sentence after being found guilty on 11 February 2011 of "divisionism" for making public speeches criticizing government policies ahead of the 2010 elections, breaching state security and attempting to plan an "unauthorized demonstration".
  • Eight members of Victoire Ingabire's FDU-Inkingi party – predominantly teachers and students – were arrested in September, after holding a meeting where they reportedly discussed development and education issues. They were charged with inciting insurrection or trouble among the population and remanded in pre-trial detention. One was released before the end of the year.
International justice
International Criminal Tribunal for Rwanda
The International Criminal Tribunal for Rwanda (ICTR) Trial Chamber transferred its first case to Rwanda, that of former Pastor Jean Uwinkindi. Several other cases were also transferred in 2012. Two ICTR staff were assigned to monitor referral cases on a temporary basis, pending agreement on trial monitoring with the African Commission on Human and Peoples' Rights. They were required to file monthly reports through the Registry to the President of the ICTR, or the President of the Mechanism for International Criminal Tribunals, as appropriate.
Universal jurisdiction
Judicial proceedings against genocide suspects took place in Belgium, Finland, Germany and the Netherlands.
  • The European Court of Human Rights rejected Sylvère Ahorugeze's appeal against the Swedish government's decision to extradite him to Rwanda. He remained in Denmark at the year's end.
  • Charles Bandora's extradition to Rwanda was pending. His case had passed through all stages of Norway's criminal justice system. His final appeal was pending.
Impunity for war crimes and crimes against humanity
The authorities did not investigate or prosecute allegations of war crimes and crimes against humanity committed by the Rwandan army in Rwanda and also the DRC, as documented in the UN Mapping Report.
Refugees and asylum-seekers
The implementation of a cessation clause for Rwandan refugees, invoked on 31 December 2011 by UNHCR, the UN refugee agency, was delayed until June 2013. Under the clause, refugees who left Rwanda up to and including 1998 would lose their status, but should be interviewed to establish any individual grounds for continued fear of persecution in Rwanda.
Prisoners of conscience
  • Charles Ntakirutinka, a former Rwandan government minister and prisoner of conscience, was released on 1 March after serving a 10-year sentence following an unfair trial. He was arrested in April 2002 during a crackdown before the 2003 presidential elections, and convicted of "inciting civil disobedience" and "association with criminal elements".

KarenziKarake, current head of the Rwandan National Intelligence and Security Service (NISS) who is internationally wanted by Spanish courts for genocide, crimes against humanity and war crimes, was spotted moving freely in London last May 18th.

In different pictures taken during the meeting led by President Kagame last Rwanda Day in London, Karake, also known as ‘‘KK’’, is seen sitting calmly in the section of Rwandan officials despite the fact that he is under an international arrest warrant issued by Spanish courts in February 2008 , and should therefore be arrested and delivered to Spain. Yet, to our knowledge, Karake was able to come and go as he pleased on British soil.

This happened in spite of the warrant against KK stating he is the ‘‘highest responsible’’ for the massacres and elimination of the Hutu population in the districts of Nyakinama and Mukingo in Rwanda.

‘‘[Karake] knew of, and had approved, the killings of the [Hutu] civilian population from 1994 to 1997 in the towns of Ruhengeri, Gisenyi and Cyangugu, among which include the killing of three Spanish aid workers from Doctors of the World’’, reads the warrant.

Furthermore, Human Rights Watch (HRW) expressed great concerns regarding KK’s ‘‘military record’’ as a commanding officer of Rwandan troops in Kisangani, DRC, in June 2000, and his role in the killings of nearly a thousand civilians. Referring to both Rwandan and Ugandan forces, the human rights organization said ‘‘both sides acted with blatant disregard for the lives of the civilians present in Kisangani’’ and asked for ‘‘further investigation into the conduct of General Karake’’. If found guilty, HRW suggested for KK to be removed from his position as a Deputy Commander in the joint Mission in Darfur of the United Nations/African Union (UNAMID).

With such accusations, General Karake would normally not venture to London for he would not be granted a visa. In any case, he would be immediately arrested according to international law. For these reasons, in 2011, France already refused KK an entry visa prior to a presidential visit. President Kagame retaliated by saying that the arrest warrants are politically motivated and only serve to limit the free movement of the accused.
Now, it seems the UK has kindly allowed for this alleged criminal’s ‘‘free movement’’, thereby violating international laws and agreements. In fact, KK’s presence at Rwanda Day suggests that even with a curriculum vitae filled with one serious crime after the other, one can still travel to the UK as he pleases. What is Great Britain’s agenda?
KK was named head of the NISS on July 13th 2011, following several other rearrangements in the Rwandan intelligence services made by President Kagame. In the new position, he gained more contact with the diaspora and the international community through Rwandan intelligence officials in Brussels, Paris and London. Earlier in 2010, during his time in the Rwandan army, he spent a few months under ‘‘house arrest’’ for ‘‘misconduct inconsistent with the principles that govern the discipline of the Rwandan Defense Forces’’. He was released after being “forgiven” by military authorities.

 Le Parlement a adopté trois résolutions distinctes ce jeudi. Il appelle à des mesures pour l'abolition de la peine de mort en Inde et pour réformer les droits de l'homme au Rwanda. Il se dit également inquiet quant à la situation des prisonniers qui font la grève de la faim à Guantanamo.

Peine de mort en Inde

La résolution condamne l'exécution secrète d'Afzal Guru dans la prison de Tihar à New Delhi, en février 2013, qui va à l'encontre de la tendance mondiale en faveur de l'abolition de la peine capitale. Les députés demandent au gouvernement indien de n'approuver aucun ordre d'exécution à l'avenir et d'instaurer un moratoire permanent sur les exécutions, afin d'abolir la peine de mort dans un avenir proche.

Droits de l'homme au Rwanda

Les députés soulignent que le procès pénal de Victoire Ingabire représente un test important en ce qui concerne la capacité du système judiciaire rwandais à traiter des affaires politiques à fort retentissement de façon équitable et indépendante. À cet égard, ils s'inquiètent que le procès n'ait pas respecté les normes internationales.

Les autorités judiciaires du Rwanda doivent enquêter sur les allégations de torture et d'autres violations des droits de l'homme, et traduire en justice les auteurs de tels crimes, demandent les députés. Elles doivent garantir la séparation des pouvoirs, et en particulier l'indépendance du système judiciaire, assurer la liberté d'expression, et réviser la loi sur l'"idéologie du génocide" afin de respecter les obligations du pays au titre du droit international, ajoutent les parlementaires.

La résolution rappelle que l'Union européenne a, formellement, fait part de ses préoccupations en ce qui concerne le respect des droits de l'homme et du droit à un procès équitable au Rwanda, conformément à l'article 8 de l'accord de Cotonou. Les députés demandent à l'Union européenne, en collaboration avec d'autres donateurs internationaux, d'exercer une pression continue afin d'encourager la réforme en faveur des droits de l'homme au Rwanda.

Grève de la faim de prisonniers à Guantanamo

Le Parlement a adopté une résolution relative à la situation des prisonniers qui font la grève de la faim à Guantanamo. Le texte appelle les autorités américaines à traiter les détenus avec humanité dans le respect de leur dignité en vue de respecter les droits de l'homme et les libertés fondamentales.

Les autorités américaines devraient réviser le système de commission militaire afin de garantir des procès équitables, de fermer Guantanamo et d'interdire, dans toutes circonstances, le recours à la torture, aux mauvais traitements et à la détention indéfinie sans procès, demandent les députés.
